Terms and Conditions

These Terms and Conditions govern access to and use of DatalytIQs Academy, including its website, learner accounts, online courses, digital learning resources, live training, corporate training, consultancy, research, analytics and related professional services. By creating an account, enrolling, purchasing a service, or otherwise using the platform, you agree to these Terms together with any programme-specific or contractual terms that apply.
1. About DatalytIQs Academy
DatalytIQs Academy provides education, analytics, research, training, consultancy and related data-driven professional services. Specific services may be delivered online, in person, through third-party platforms, or under separate proposals, quotations, engagement letters or contracts.
2. Eligibility and accounts
You must provide accurate and current information when creating an account or placing an order. You are responsible for safeguarding your login credentials and for activity carried out through your account. You must notify DatalytIQs Academy promptly if you reasonably suspect unauthorised access or misuse.
3. Courses, enrolment and access
Course descriptions, schedules, access periods, prerequisites, assessment requirements and certification conditions may differ between programmes. Enrolment does not guarantee successful completion or certification. Certificates, where offered, are subject to satisfying the applicable academic, attendance, assessment or payment requirements.
4. Fees and payments
Prices and payment requirements are those displayed or formally quoted at the time of purchase or engagement. Payments may be processed by third-party payment providers. You are responsible for providing accurate billing and transaction information. DatalytIQs Academy may suspend access to paid services where a payment is reversed, disputed, overdue or otherwise not successfully completed, subject to applicable law and agreed contractual terms.
5. Refunds and cancellations
Refund and cancellation requests are governed by the published Refund and Cancellation Policy and any programme-specific or contractual terms. Mandatory consumer rights under applicable Kenyan law are not excluded or restricted by these Terms.
6. Privacy and personal data
Personal data is handled in accordance with the published Privacy Policy and applicable Kenyan data-protection law. By using the platform, you acknowledge that information necessary to provide, secure and administer the relevant service may be processed in accordance with that policy.
7. Acceptable use
You must not use DatalytIQs Academy to violate applicable law; compromise platform security; attempt unauthorised access; distribute malicious software; impersonate another person; interfere with another learner or user; scrape or reproduce restricted resources without permission; share paid account access unlawfully; or use learning, assessment or professional materials in a fraudulent or misleading manner.
8. Intellectual property
Unless expressly stated otherwise, course materials, assessments, datasets prepared for instruction, templates, graphics, written content, videos, methodologies and other original resources supplied by DatalytIQs Academy remain the intellectual property of their respective owner or licensor. A learner’s purchase or enrolment grants a limited, personal, non-exclusive and non-transferable right to use supplied materials for the authorised learning or professional purpose. It does not transfer ownership or grant a right to resell, republish or commercially redistribute the materials.
9. Learner submissions and academic integrity
You retain rights you lawfully hold in your original submissions. You grant DatalytIQs Academy the limited permission necessary to receive, store, review and assess submissions and to administer the learning service. Plagiarism, impersonation, unauthorised collaboration, falsification of results or other academic misconduct may result in assessment action, suspension or termination of access, subject to the applicable programme rules.
10. Third-party services
The platform may integrate hosting, payment, email, video, analytics, security, ecommerce, learning-management or other third-party services. Their availability and operation may be subject to separate provider terms. DatalytIQs Academy is not responsible for independent third-party services beyond obligations imposed by applicable law or an express agreement.
11. Service availability and changes
We may perform maintenance, security updates and reasonable platform modifications. Course schedules, instructors or delivery arrangements may occasionally change where reasonably necessary. Where a material change affects a paid service, DatalytIQs Academy will seek to provide an appropriate alternative, rescheduling, credit or other remedy consistent with the applicable agreement and law.
12. Professional services
Consultancy, research, analytics, corporate training and customised engagements may be governed by a separate proposal, quotation, purchase order, engagement letter or contract. Where those specific terms conflict with these general Terms, the specific written terms govern that engagement to the extent permitted by law.
13. Disclaimers and limitation
Educational and analytical materials are provided for learning, research and decision-support purposes and should be interpreted in their proper context. Except where expressly agreed, DatalytIQs Academy does not guarantee employment, promotion, examination results, business outcomes or a particular decision resulting from use of its educational content. Nothing in these Terms excludes liability or a right that cannot lawfully be excluded under Kenyan law.
14. Suspension and termination
DatalytIQs Academy may restrict or terminate access where reasonably necessary because of serious or repeated breach of these Terms, fraud, unlawful activity, security threats, non-payment or misuse of the platform. Where practicable and appropriate, users will be informed of the reason and any available corrective process.
15. Governing law and disputes
These Terms are governed by the laws of Kenya. The parties should first attempt to resolve a dispute through good-faith communication. Nothing in this clause prevents a consumer or data subject from exercising a statutory right or approaching a competent regulator, tribunal or court.
16. Changes to these Terms
We may update these Terms to reflect changes in services, technology, operational requirements or law. The current version will be identified by its last-updated date. Material changes affecting an existing paid engagement will be handled consistently with applicable law and any specific contract.
